TN Visas

Basic Summary

The TN or Trade NAFTA Status was authorized by the North American Free Trade Agreement and is only applicable for Mexican and Canadian nationals. Only certain occupations qualify for TN status.

Countries

As described above, only Mexican and Canadian nationals qualify for TN Visas.

Quota

There are no Visa Quotas associated with TN Visas.

Spousal and Dependent Work Authorization

Spouses do not qualify for work authorization under the TN program.

Duration

TN Visas are ordinarily granted for up to three years at a time and can be extended indefinitely. Holders of TN status should note that immigration officials are often unwilling to extend TN Visas beyond 5-7 years under the belief that TN Visa holders who are in the United States for long periods of time ought to seek U.S. Permanent Residency.
